Terms of Use
These terms govern your use of this website. Please read them, along with our Privacy Notice. Our advisory services are provided only under a signed engagement agreement.
Effective date:
Acceptance of these terms
By accessing or using meritasadvisory.com (the “Site”), you agree to these Terms of Use. If you do not agree, please do not use the Site. The Site is operated by Meritas Real Estate Advisory, Inc., a California corporation (“Meritas,” “we,” “us” or “our”).
About Meritas and licensing
Meritas provides real estate advisory services to owners of income property, and operating advisory services to property management firms and their investors. Gregory (Greg) De Rubeis, Founder & Managing Principal, is a California real estate broker, license number 01487050, issued by the California Department of Real Estate. You can verify license status on the Department of Real Estate’s website at dre.ca.gov.
Meritas does not provide property management services, and it is not a law firm, accounting firm, investment adviser, mortgage broker, insurance broker, or licensed inspection or engineering firm. Where a matter calls for one of those professionals, we will say so, and you will engage that professional directly.
No client relationship through the Site
Using the Site, reading its content or contacting us does not create an advisory, agency, fiduciary or other professional relationship between you and Meritas. A client relationship begins only when you and Meritas sign a written engagement agreement, and the scope of our services, fees and responsibilities are governed solely by that agreement.
Until an engagement agreement is signed, please do not send us confidential information. Information you send before then may not be treated as confidential.
Site content is general information
The content on the Site, including Insights articles, is provided for general informational purposes only. It is not legal, tax, accounting, investment, financing, insurance, engineering or real estate advice about your particular situation, and it should not be relied on as such.
Laws and regulations, including California rental housing rules, change often and vary by city, county and property. Content may not reflect the most current legal developments. Examples are illustrative. Before acting on any information on the Site, consult your attorney, CPA or other qualified professional about your circumstances.
Experience and results
Descriptions of Greg De Rubeis’s professional experience, including figures such as unit counts, property values and acquisitions, describe roles he held at other firms before founding Meritas. They are not results achieved by Meritas and are not a promise or prediction of any future result. Every portfolio is different, and no advisor can guarantee a rent, a return or any other outcome.
Intellectual property
The Site and its content, including text, graphics, the Meritas name, the hexagon mark and logos, are owned by or licensed to Meritas and are protected by copyright, trademark and other laws. You may view the Site and print or share individual pages for your personal, noncommercial use, and you may quote brief excerpts with attribution and a link to the original page. Any other copying, republication or commercial use requires our written permission.
Acceptable use
You agree not to use the Site in any unlawful way; to submit false, misleading or unsolicited commercial messages through it; to attempt to gain unauthorized access to it or the systems behind it; to introduce malware or other harmful code; or to interfere with its operation or with anyone else’s use of it.
Links to other websites
The Site may contain links to websites operated by others. Those links are provided for convenience only. We do not control and are not responsible for the content, accuracy or practices of other websites, and a link does not imply endorsement.
Fair housing
Meritas supports the principles of fair housing and equal opportunity. We comply with federal, state and local fair housing laws and do not discriminate on the basis of any characteristic protected by law.
Disclaimer of warranties
The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, Meritas disclaims all warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components.
Limitation of liability
To the fullest extent permitted by law, Meritas and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue or data, arising out of or related to your use of, or inability to use, the Site or its content, even if advised of the possibility of such damages. Our total liability for any claim arising out of or related to the Site will not exceed one hundred dollars ($100). Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you. This section does not limit any obligation under a signed engagement agreement, which is governed by its own terms.
Indemnification
You agree to indemnify and hold harmless Meritas and its officers, employees and agents from any claims, losses and expenses, including reasonable attorneys’ fees, arising out of your violation of these terms or your misuse of the Site.
Governing law and venue
These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute arising out of or related to the Site will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts.
Changes to these terms
We may update these terms from time to time by posting a revised version on this page and changing the effective date above. Your continued use of the Site after a change means you accept the revised terms.
General
If any part of these terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver of it. These terms, together with our Privacy Notice, are the entire agreement between you and Meritas about your use of the Site. They do not govern any advisory services, which are governed only by a signed engagement agreement.
